TERMS OF SERVICE & CHARTER REGULATIONS
Effective Date: January 1, 2026. These terms define the binding charter agreement between the client and Pickoracuriouscrew Mobility GmbH for all private, corporate, and intercity party bus operations.
1. Scope and Contractual Formation
All charter reservations, route commissions, and on-board hospitality provided by Pickoracuriouscrew Mobility GmbH ("the Company") are conducted exclusively under these Terms of Service. Transmitting a reservation booking request through our online terminal constitutes an offer to contract. A binding contract is concluded solely upon written dispatch confirmation and receipt of the required charter commitment deposit.
2. Vessel Capacity and Guest Safety Obligations
Each vessel in our fleet possesses an inflexible passenger capacity certified by German TÜV Rheinland inspections (Apex Titan: max 50 passengers; Interceptor: max 26 passengers). Under no circumstances will boarding clearance be extended past registered thresholds. The primary client is legally responsible for ensuring that all guests follow crew instructions, remain clear of pilot cockpits, and avoid behavior that endangers road transit.
The vehicle pilot possesses absolute statutory authority (Hausrecht) under German road traffic regulations (StVO). If passenger actions threaten the physical safety of the crew, vehicle, or other road users, the pilot is authorized to abort the charter immediately without refund.
3. Payment Schedules, Deposits, and Cancellations
Unless expressly stipulated otherwise in the individual charter offer:
- A non-refundable reservation deposit of 40% of the total charter sum is due within 7 calendar days of contract issuance.
- The remaining balance of 60% must be fully received 14 days prior to the scheduled dispatch timestamp.
- Cancellations finalized between 30 and 15 days prior to dispatch will incur a 60% cancellation fee. Cancellations under 14 days incur 100% of the contract total.
4. Limitation of Liability and Equipment Protection
The Company maintains extensive public passenger transport insurance policies required by German federal law. However, the Company accepts no liability for delays resulting from traffic gridlock, extreme winter weather conditions, police roadblocks, or force majeure events outside our direct mechanical control.
Clients are strictly liable for willful damage to audio-visual rigs, CDJ mixing consoles, custom leather furnishings, or cryogenic fixtures caused by negligent behavior. Professional sanitation fees for excessive interior contamination start at €350 net.
5. Governing Law and Legal Jurisdiction
The contractual relationship is governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from or connected to this agreement is Berlin, Germany.
